Transferred Intelligence: Legal and Philosophical Foundations for the Digitization of Human Consciousness and the Human Mind in Mexico by 2030
Author : Gersson Rodriguez Gallardo, Mayra Janett Merida Monter
Abstract : This research addresses the imminent convergence between artificial intelligence and the law, focusing on transferred intelligence: the possibility of digitizing human consciousness onto technological media by the year 2030. The central problem lies in the biocentric paradigm of the Mexican legal system, which limits legal personality exclusively to biological organisms, leaving a regulatory vacuum regarding digital identity and the autonomy of non-organic consciousness. Through a qualitative and transdisciplinary approach that integrates the philosophy of mind and legal hermeneutics, the study analyzes the need to transition toward a “medium-agnostic” legal framework. The proposal examines models of language and communication that contribute to efficient and dignified epistemic construction. The ultimate goal is to determine the legal and philosophical foundations that underpin comprehensive regulation in Mexico. This dogmatic reengineering seeks to ensure that digitized consciousness is recognized as a subject of rights, guaranteeing the continuity of legal personality and human dignity in the post-biological scenario of the near future.
