Community Policing to Prevent People Smuggling in the Lens of Indonesian Immigration In the Implementation of Human Rights (Efforts to Handle and Cooperate Institutions in Handling It)

Abstract :Community policing is the right strategy for the Police to be able to partner equally with the community so that it becomes an early warning system for various problems and crimes. This is explained in the concept of Crime Prevention Strategy, Community Policing, and framed in the framework of partnership theory, situational crime prevention theory, and community-based crime prevention. People Smuggling which we call Human Smuggling is a crime against humanity that is consciously committed by the Subject of the crime. Indonesia is one of the countries with a high number of human smuggling crimes with several motives for the crime, including economic needs and invitations from relatives who are successful in the destination country. The phenomenon of people smuggling in Indonesia is closely related to immigration. This is because people smuggling crimes involve immigration factors including, traffic in and out of Indonesia, Foreign Citizens, Indonesian Citizens and State Sovereignty. Therefore, the importance of law enforcement and optimal eradication efforts need to be carried out by realizing various cooperation between institutions and ministries so that people smuggling crime practices in Indonesia can be suppressed and minimized in order to realize the guarantee of national and state security. The research method used is qualitative descriptive research and a normative legal approach. From the results of the study, it can be seen that People Smuggling Crime is a transnational crime that threatens the country from two sides, from outside and inside, and violates Human Rights. From the outside, human smuggling is carried out by illegal foreign immigrants who make Indonesia a transit area. While the internal threat is the practice of people smuggling carried out by Indonesian citizens who want to work as Migrant Workers abroad through illegal channels or also called Non-Procedural TKI or Illegal Migrant Workers (TMI). With the existence of these two threats, more attention needs to be given in eradicating these crimes. Implementation of cooperation between institutions is one of the answers to existing problems
